The maritime carrier: it is the company Voiles et Traditions Chantier Naval, trading under the name Voiles & Traditions, whose registered office is located at 22 Brezel Nevez 22470 Plou\u00e9zec, registered with the RCS of Saint-Brieuc under number B 395003338, which operates, among others, the vessels N\u00e9buleuse, (blue certificate of nationality No. 7079\/3220\/3) and Enez Koalen (blue certificate of nationality No. 6929\/3220\/2), commercial vessels. Voiles & Traditions is represented by its Managing Director, C\u00e9dric Lagrifoul, and is hereinafter referred to as the maritime carrier.<\/p>\n\n\n\n

Preamble<\/div>\n\n\n\n

The Buyer: refers to the legal or natural person who purchases one or more seat(s) {ticket(s) or transport ticket(s)}.<\/p>\n\n\n\n

The purchaser undertakes to inform the passengers for whom they are purchasing the seat(s) of all the general terms and conditions set out below, and, for minor children, their legal guardians. The purchase of seats on board, regardless of the duration of the service (day trip, cruise, etc.), constitutes acceptance of these general terms and conditions, which passengers are deemed to have read, and ignorance thereof shall not in any way exempt them from compliance.<\/div>\n\n\n\n

The liability of the maritime carrier shall not be extended beyond these general terms and conditions.<\/p>\n\n\n\n

These General Conditions apply to all vessels operated by the maritime carrier and to all its services, regardless of the port of departure or arrival. Passengers agree, in all cases, to be subject to the General Terms and Conditions of Sale established by the maritime carrier.<\/p>\n\n\n\n

It is agreed as follows:<\/div>\n\n\n\n
    \n
  1. \u2013 Shipping<\/strong><\/li>\n<\/ol>\n\n\n\n

    The purchaser purchases one or more adult and\/or child berths to participate in a cruise, the duration of which is indicated on the shipping carrier\u2019s commercial documents (a few hours to several weeks). Boarding is scheduled on vessels commercially operated by the shipping carrier.<\/p>\n\n\n\n

    The carrier guarantees to provide the berth(s) on board with a professional crew. On-board expenses, including provisions and water, and port charges are not necessarily included; the buyer must refer to the commercial offer.<\/p>\n\n\n\n

    The Buyer is informed that:<\/p>\n\n\n\n

      \n
    • the vessel La N\u00e9buleuse has an embarkation capacity of 38 day passengers, 18 overnight passengers (4 double berths, 2 twin berths and 6 single berths), and 12 passengers on international voyages;<\/li>\n\n\n\n
    • The vessel Enez Koalen has an embarkation capacity of 13 passengers per day.<\/li>\n<\/ul>\n\n\n\n
        \n
      1. \u2013 Prices and Payment<\/strong><\/li>\n<\/ol>\n\n\n\n

        The price of the seat(s) must be paid in full before each boarding, in accordance with the applicable rates. The price of the seat(s) is considered definitively earned and will not be refunded under any circumstances, except as stated below.<\/p>\n\n\n\n

        For usage taxes, port dues, VAT, and the Tax on Protected Natural Areas (Barnier tax), please refer to the commercial offer to confirm that they are included.<\/p>\n\n\n\n

        The shipping carrier reserves the right to modify rates at any time and without prior notice, depending on economic conditions or changes in taxes (usage fees, port dues, VAT, and tax on protected natural areas, etc.).<\/p>\n\n\n\n

        Passengers must retain their transport ticket (ticket, exchange voucher, invoice, contract, etc.) in order to present it upon any inspection. In the event of loss, theft, or similar circumstances involving the transport ticket, no duplicate will be issued; the buyer or passenger must purchase a new transport ticket to ensure their service. Any fine resulting from the failure to present the transport ticket to authorities due to loss, theft, or similar circumstances shall be the sole responsibility of the passenger or their legal representative.<\/p>\n\n\n\n

        Each purchased seat is valid only after the full amount has been received by the maritime carrier. The maritime carrier accepts online purchases with secure payment, as well as purchases at embarkation ports payable by check, holiday vouchers, cash, or exchange vouchers from partners with whom the maritime carrier has previously entered into an agreement.<\/p>\n\n\n\n

        No seats are numbered or assigned.<\/p>\n\n\n\n

        The sale of seats or transport tickets and last-minute boarding is possible subject to availability and the time of presentation before the scheduled departure time.<\/p>\n\n\n\n

          \n
        1. \u2013 Insurance<\/strong><\/li>\n<\/ol>\n\n\n\n

          The carrier undertakes to ensure that passengers’ civil liability is covered on its vessels. The carrier assumes no liability for accidents occurring outside its vessels.<\/p>\n\n\n\n

          The carrier requests that passengers take out individual travel insurance (e.g., assistance, emergency repatriation) for cruises abroad or at sea.<\/p>\n\n\n\n

            \n
          1. \u2013 Boarding conditions<\/strong><\/li>\n<\/ol>\n\n\n\n

            Boarding the ships is subject to passengers’ full compliance with the safety standards imposed on each vessel (passenger numbers, navigation conditions, etc.).<\/p>\n\n\n\n

            Passengers must therefore follow the instructions given by the crew or the maritime carrier. Minors travel under the supervision and responsibility of their parents or the accompanying adult.<\/p>\n\n\n\n

            Subject to weather and sea conditions, the shipping carrier reserves the right to refuse boarding to pregnant women. Please consult your doctor before boarding.<\/p>\n\n\n\n

            The maritime carrier welcomes passengers with disabilities; however, under certain conditions, boarding is not possible:<\/p>\n\n\n\n

              \n
            • port facilities not accessible for safe embarkation or disembarkation;<\/li>\n\n\n\n
            • dimensions of the vessel or its access routes;<\/li>\n\n\n\n
            • boarding of electric wheelchairs, number of wheelchairs;<\/li>\n\n\n\n
            • access to onboard toilets ;<\/li>\n\n\n\n
            • etc.<\/li>\n<\/ul>\n\n\n\n

              We request that persons with disabilities contact the maritime carrier prior to purchasing a ticket to determine the feasibility of boarding.<\/p>\n\n\n\n

              Passengers suffering from illnesses, even serious ones, that are non-contagious, may consult their physician and, in certain cases, inquire with the maritime carrier prior to purchasing their ticket (Captain C\u00e9dric Lagrifoul is bound by medical confidentiality); for example, to determine the feasibility of connecting a respiratory device, etc.<\/p>\n\n\n\n

              Passengers are strictly prohibited from carrying spirits, flammable, explosive or hazardous materials, firearms or knives, drugs and prohibited substances; the shipping company and\/or the crew reserve the right to take all measures to prevent this and to initiate legal proceedings. The shipping company does not permit passengers who are intoxicated or under the influence of drugs to board.<\/p>\n\n\n\n

              Selling fish caught by passengers is prohibited by law. All drugs are prohibited on board.<\/p>\n\n\n\n

              Animals are not permitted on board except with written and exceptional authorization from the maritime carrier.<\/p>\n\n\n\n

              The maritime carrier advises against bringing valuables or large sums of money on board. Large sums of money and\/or personal items and\/or valuables are under the sole responsibility and supervision of each passenger.<\/p>\n\n\n\n

              In order to ensure the best possible conditions for a coastal or offshore cruise, each passenger must avoid risky situations:<\/p>\n\n\n\n

                \n
              • by supervising and accompanying their children on board as well as in the boarding and disembarkation areas (quays, pontoons, etc.);<\/li>\n\n\n\n
              • while moving carefully on board, by nature it is an environment different from land-based environments: presence of steps and low headroom, unpredictable ship movements, etc.;<\/li>\n\n\n\n
              • by protecting their personal belongings: phone, computer,… from theft and possible salt spray;<\/li>\n\n\n\n
              • while paying attention to the crew’s announcements and instructions.<\/li>\n<\/ul>\n\n\n\n

                Passengers must proceed with caution during boarding and disembarkation on ramps, pontoons, quays, and intertidal zones (the area that is covered and exposed by the tide).<\/p>\n\n\n\n

                Each passenger must adhere to personal hygiene rules during cruises (lasting several days and nights) in accordance with the Captain’s instructions.<\/p>\n\n\n\n

                Each passenger must respect the marine environment (the sea and sites visited).<\/p>\n\n\n\n

                No passenger may use, without the written consent of the maritime carrier, the image and\/or name and\/or logo of a vessel or the maritime carrier (Voiles & Traditions).<\/p>\n\n\n\n

                For offshore and international voyages: each passenger must carry a valid identification document (card or passport, depending on the country) and be up to date with mandatory vaccinations (depending on the country visited).<\/p>\n\n\n\n

                  \n
                1. \u2013 Modification of routes, boarding and disembarkation locations, schedules and deadlines<\/strong><\/li>\n<\/ol>\n\n\n\n

                  The scheduled itinerary, the boarding and disembarkation point, the times and dates are as indicated in the commercial offer (with weather-dependent stops, where applicable).<\/p>\n\n\n\n

                  In the event of adverse weather or sea conditions, for safety reasons, to assist in saving human lives or property, etc., the itinerary may be modified (ports of call, routes…). The Ship’s Captain or the maritime carrier may, if he deems it necessary, alter an itinerary, disembark one or more passengers, change the embarkation or disembarkation locations, and take any decisions he deems appropriate.<\/p>\n\n\n\n

                  Likewise, schedules and timeframes are always provided for informational purposes only and may be modified at any time by the Captain or the maritime carrier without prior notice.<\/p>\n\n\n\n

                  The maritime carrier shall not be held liable for the consequences of vessel delays and\/or itinerary changes, for example, a missed train, a missed appointment, the additional cost of accommodation, the additional cost of transport, etc.<\/p>\n\n\n\n

                  The itinerary, boarding and disembarkation locations, schedules and timeframes are therefore never binding.<\/p>\n\n\n\n

                  The application of this clause shall not give rise to any compensation from the maritime carrier to the passengers or the buyer.<\/p>\n\n\n\n

                  However, where possible, the Captain or the maritime carrier will notify passengers of changes to the itinerary, embarkation and disembarkation locations, schedules, and timings.<\/p>\n\n\n\n

                    \n
                  1. \u2013 Cancellation or postponement of transport<\/strong><\/li>\n<\/ol>\n\n\n\n

                    The maritime carrier shall not be held liable for missed departures by passengers caused by traffic conditions (parking, traffic congestion, train delays, bus delays, etc.).<\/p>\n\n\n\n

                    1\/ Cancellation at the initiative of the buyer or passenger(s):<\/p>\n\n\n\n

                    a\/ less than 90 days prior to boarding, the amounts collected by the maritime carrier shall remain non-refundable (balance due in all cases).<\/p>\n\n\n\n

                    Failure to appear fifteen minutes before the scheduled departure time shall be considered a cancellation initiated by the passenger. Any passenger, even if holding a valid ticket, who arrives after this time limit and is unable to board shall have no recourse against the maritime carrier and shall not be entitled to a refund.<\/p>\n\n\n\n

                    All sums received by the maritime carrier shall remain non-refundable.<\/p>\n\n\n\n

                    b\/ more than 90 days before embarkation, then the amounts received by the carrier would be deferred to another embarkation date at the passengers’ choice (subject to availability). The buyer and the passengers would not be entitled to a refund of the amounts paid, and the buyer would remain liable for 50% of the total service amount.<\/p>\n\n\n\n

                    All sums received by the maritime carrier shall remain non-refundable.<\/p>\n\n\n\n

                    c\/ If, for any reason whatsoever, one or more passengers were to interrupt their stay, then no compensation shall be paid and no repatriation costs shall be payable.<\/p>\n\n\n\n

                    Any cancellation initiated by the purchaser or by one (or more) passenger(s) shall permit the maritime carrier to resell the concerned berth(s) without the maritime carrier being required to refund the said berth(s) to the purchaser and\/or to each passenger, and without the purchaser and\/or passenger being entitled to any compensation.<\/p>\n\n\n\n

                    All sums received by the maritime carrier shall remain non-refundable.<\/p>\n\n\n\n

                    2\/ Cancellation at the initiative of the maritime carrier or the ship’s master:<\/p>\n\n\n\n

                    The maritime carrier shall not be held liable for the consequences of its cancellation and\/or a force majeure event, for example, missing a train, missing an appointment, additional accommodation costs, additional transport costs, etc.<\/p>\n\n\n\n

                    The application of this clause shall not give rise to any compensation from the maritime carrier to the passengers or the buyer.<\/p>\n\n\n\n

                    a\/ in the event of a problem related to the vessel (damage, technical issues) or in the event of a postponement due to a lack of passengers {departures are guaranteed with a minimum of 4 paying adult passengers per day on Enez Koalen, with a minimum of 22 paying adult passengers per day on La N\u00e9buleuse and with a minimum of 8 paying adult passengers on a cruise (multiple days and nights on board) on La N\u00e9buleuse} then the maritime carrier or the Captain may, at any time, postpone boarding to another date of the purchaser’s or passengers’ choice (subject to available dates) or make seats available on a replacement vessel(s).<\/p>\n\n\n\n

                    In the event of refusal by the buyer or the passengers, the transport would be cancelled and the amounts paid would be fully refunded by the maritime carrier to the buyer. Should a problem arise during transport necessitating its curtailment, the maritime carrier would refund the buyer on a pro rata basis for the uncompleted duration of the transport.<\/p>\n\n\n\n

                    In all these cases, the buyer or the passengers would not be entitled to any compensation or damages.<\/p>\n\n\n\n

                    The crew is not authorized to process refunds. The maritime carrier’s headquarters handles refunds.<\/p>\n\n\n\n

                    b\/ in the event of force majeure (e.g., weather conditions, port strike, war, illness, epidemic, injury on board, orders from the authorities, etc.), the maritime carrier or the Captain may at any time postpone boarding to another date at the buyer’s or passengers’ choice (subject to available seats and dates) or suspend the transport if it has already commenced. No passenger shall be entitled to any compensation.<\/p>\n\n\n\n

                    All sums collected by the maritime carrier shall be retained. 3\/ Transfer of space(s):<\/p>\n\n\n\n

                    The buyer may transfer their seat(s) to another person subject to the following conditions:<\/p>\n\n\n\n

                      \n
                    • to comply with the commercial offer: same date and time, same age (adult or child);<\/li>\n\n\n\n
                    • to inform the relevant persons, for whom the seat(s) are sold, of all the general terms and conditions of sale herein, and, for minor children, their legal guardians;<\/li>\n\n\n\n
                    • to provide information regarding the person(s) for whom he is transferring the seat(s) and generally all information required by the maritime carrier (name(s), contact details, age, etc.);<\/li>\n\n\n\n
                    • The buyer remains the point of contact with the shipping carrier for any disputes that may arise.<\/li>\n<\/ul>\n\n\n\n

                      All sums received by the maritime carrier shall remain non-refundable.<\/p>\n\n\n\n

                        \n
                      1. \u2013 Recommended equipment for passengers:<\/strong><\/li>\n<\/ol>\n\n\n\n

                        Clothing suitable for the weather and itinerary (warm and waterproof clothing), flat shoes (non-slip), sunglasses and sunscreen.<\/p>\n\n\n\n

                        For an overnight stay on board: 1 sleeping bag, 1 pillowcase (60 x 60 cm), toiletries (including towel). Only soft bags are permitted (no large and\/or hard-sided suitcases). Prohibited: high heels and\/or stilettos, and shower gel (liquid soap).<\/p>\n\n\n\n

                          \n
                        1. \u2013 Liability<\/strong><\/li>\n<\/ol>\n\n\n\n

                          The liability of the maritime carrier is limited in all circumstances to the period during which each passenger is on board under the direct control of the crew, excluding any installations and structures on land or at sea that are not the ship itself.<\/p>\n\n\n\n

                          The liability of the maritime carrier may only be invoked within the framework of the laws applicable to maritime transport. The insurance compensation that may be awarded is limited by these laws.<\/p>\n\n\n\n

                            \n
                          1. \u2013 Complaint<\/strong><\/li>\n<\/ol>\n\n\n\n

                            Any claim against the maritime carrier must be submitted by registered letter (with return receipt) to its registered office, accompanied by any supporting documents, within 15 days of the date on which the loading took place or should have taken place.<\/p>\n\n\n\n

                              \n
                            1. \u2013 Jurisdiction, competence of courts<\/strong><\/li>\n<\/ol>\n\n\n\n

                              All limitations, exemptions and stipulations of these general terms and conditions of sale shall apply, where applicable, to the liability of agents, employees and other representatives of the maritime carrier, as well as to ships and installations on land or on water.<\/p>\n\n\n\n

                              For all actions brought before a court, only French law shall apply.<\/p>\n\n\n\n

                              For the performance of these terms, exclusive jurisdiction shall be vested in the Commercial Court of Saint-Brieuc.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
